These Terms and Conditions ("Terms") govern the use of the website operated by Gusike and the provision of the Affordable Car Leasing Program services described on this website. By using this website or placing an order, you agree to be bound by these Terms. These Terms are drafted in accordance with Polish law, in particular the Polish Civil Code (Kodeks cywilny), the Act of 30 May 2014 on Consumer Rights (Ustawa o prawach konsumenta), and the Act of 18 July 2002 on the Provision of Electronic Services (Ustawa o świadczeniu usług drogą elektroniczną).
The services described on this website are provided by:
All correspondence, requests, complaints, or exercise of statutory rights should be directed to the contact details listed above. We aim to respond to all inquiries within a reasonable timeframe and, where applicable, within statutory deadlines under Polish consumer protection law.
Orders for participation in the Affordable Car Leasing Program may be submitted through the forms available on this website or by contacting us directly via email or phone. An order constitutes an offer to enter into an agreement with Gusike and does not become binding until confirmed in writing by Gusike, typically via a confirmation email sent to the address provided by the customer.
The confirmation will include the essential terms of the leasing arrangement, including the identification of the vehicle, the applicable pricing, and the duration of the lease. Customers are advised to review the confirmation carefully and to notify Gusike immediately of any discrepancies.
All prices displayed on this website are quoted in Polish złoty (PLN) and, unless otherwise stated, include applicable Polish value-added tax (VAT). Prices are subject to change; however, once an order has been confirmed, the price stated in the confirmation remains binding for that transaction.
Payment terms, including any deposit, instalment schedule, or full upfront payment, will be specified at the time of order confirmation. Unless expressly stated otherwise, the leasing fee covers use of the vehicle for the agreed term but does not include fuel, tolls, parking fees, insurance excess, or damage beyond normal wear and tear, which remain the responsibility of the customer.
Consumers who conclude an agreement with Gusike at a distance (e.g. through this website) have the right to withdraw from the agreement within 14 days without giving any reason, in accordance with the Act on Consumer Rights, unless the agreement falls under a statutory exception applicable to leasing services already performed in full with the consumer's express consent.
To exercise the right of withdrawal, the customer must inform Gusike of their decision by a clear statement sent to [email protected] before the deadline expires.
Complaints regarding the services provided may be submitted at any time via email or phone using the contact details above. Complaints will be examined within 14 calendar days. If the customer is a consumer and remains dissatisfied with the outcome, they may seek assistance from the President of the Office of Competition and Consumer Protection (Prezes Urzędu Ochrony Konkurencji i Konsumentów) or use out-of-court dispute resolution mechanisms available under Polish law.
Gusike shall exercise reasonable care in the provision of its services; however, to the maximum extent permitted by Polish law, Gusike shall not be liable for indirect or consequential losses arising from the use of the leased vehicle, delays caused by circumstances beyond its reasonable control, or misuse of the vehicle by the customer. Nothing in these Terms limits liability that cannot be excluded or limited under mandatory provisions of Polish law, including liability for intentional harm or gross negligence.
